Terms of Service
Governs access to courses, examinations, certificates, and business training on app.foodsafetyacademy.ca.

1. Acceptance of Terms
These Terms of Service govern access to and use of the Food Safety Academy online learning platform, course materials, examinations, proctoring tools, certificate services, business training services, and related support services.
By creating an account, purchasing a course, accessing course materials, taking an examination, accepting a business invitation, or using the Food Safety Academy platform, you agree to be bound by these Terms of Service, the Privacy Policy, the Examination Policy, Refund Policy, Accessibility and Special Accommodations Policy, and any other policies referenced by Food Safety Academy.
If you do not agree with these Terms, you must not access or use the platform.
2. Course Access and License
Food Safety Academy grants each registered student a limited, personal, revocable, non-exclusive, non-transferable license to access the purchased course and related materials solely for personal training and certification purposes.
Course access is for one individual user only. Accounts, course materials, examinations, certificates, login credentials, and access links may not be shared, transferred, sold, assigned, sublicensed, copied for others, or used by any person other than the registered student.
Business purchases may provide multiple seats, but each seat must be assigned to a specific individual learner. Each learner must complete the course and examination personally.
3. Eligibility
The Food Safety Academy Food Handler certification course is intended for individuals aged 18 years or older. By registering, you represent that you are at least 18 years old and legally able to enter into these Terms.
A valid government-issued photo identification document is required before accessing the proctored final examination. Students must also have access to a working webcam and microphone, a compatible device and browser, and a private, quiet examination environment.
Food Safety Academy reserves the right to refuse, suspend, or terminate access where eligibility requirements are not met or where identity cannot be verified.
4. User Responsibilities
Users are responsible for:
- Providing accurate, current, and complete registration, identity, billing, and contact information.
- Maintaining the confidentiality of account credentials.
- Completing the course and examination personally and honestly.
- Complying with all examination, proctoring, identity verification, and certificate rules.
- Maintaining a compatible device, internet connection, webcam, microphone, and browser.
- Reviewing course content before attempting the examination.
- Promptly notifying Food Safety Academy of account misuse, suspected fraud, technical issues, or incorrect information.
- Using the platform in compliance with Canadian laws and all applicable policies.
Food Safety Academy is not responsible for a student's failure to meet technical requirements, identity verification requirements, examination rules, or course completion requirements.
5. Prohibited Conduct
The following conduct is prohibited:
- Cheating, attempting to cheat, or assisting another person to cheat.
- Impersonating another student or allowing another person to complete the course or examination.
- Sharing, copying, photographing, recording, publishing, selling, or distributing examination questions, answers, course content, certificates, login credentials, or restricted materials.
- Using unauthorized notes, websites, artificial intelligence tools, messaging tools, phones, secondary devices, or reference materials during the examination.
- Bypassing, disabling, interfering with, or attempting to evade proctoring, identity verification, browser lockdown, technical controls, or platform security.
- Providing false identity, payment, business, or certification information.
- Harassing, abusing, threatening, or interfering with Food Safety Academy staff, instructors, support personnel, students, or reviewers.
- Uploading malicious code, attempting unauthorized access, scraping, reverse engineering, or disrupting platform operations.
- Using the platform for unlawful, fraudulent, misleading, or harmful purposes.
Violation of this section may result in warnings, examination termination, failed attempts, certificate revocation, account suspension, permanent ban, no refund, legal action, and notification to relevant authorities where appropriate.
6. Payment Terms
All prices are stated in Canadian dollars (CAD), unless otherwise indicated.
Individual Purchases
Individual students must pay the applicable course fee before receiving course access, unless Food Safety Academy has expressly approved another arrangement.
Business Purchases
Business clients may purchase seats by credit card, e-transfer, invoice, or other approved method. Invoice terms, where offered, will be stated on the invoice or written agreement. Food Safety Academy may suspend access to unpaid seats or accounts if payment is not received according to the applicable terms.
Taxes and Fees
Applicable taxes, processing fees, invoice terms, discounts, or administrative fees may be added or applied as required. Students and business clients are responsible for providing accurate billing information.
7. Refund Policy
Food Safety Academy offers a full refund within 7 days of purchase if the student has not accessed any course content or started any module.
No refund is available once a student has accessed course content, started any module, attempted the final examination, violated examination rules, engaged in fraudulent conduct, or received a certificate, unless required by applicable law or approved by Food Safety Academy in writing.
No refund is available after an examination attempt.
Approved refunds will be processed within 10 business days using the original payment method where possible. Processing times may vary depending on the payment provider or financial institution.
Business, invoice, bulk seat, promotional, or custom pricing refunds may be governed by separate written terms.
8. Examination Rules
The final examination is monitored by FSA's automated AI-assisted proctoring service and is subject to Food Safety Academy's Examination Policy. The course is designed for 6+ hours of learning before certification.
Students must:
- Complete all required course modules before attempting the final examination.
- Present valid government-issued photo identification.
- Complete identity verification, including required selfie/photo verification.
- Use a working webcam and microphone.
- Take the examination in a quiet, private location.
- Keep the webcam active during the examination.
- Use only the permitted examination browser or locked examination environment.
- Comply with browser lockdown and proctoring rules.
- Avoid all unauthorized resources, devices, assistance, communication, or reference materials.
The final examination consists of 50 questions. A passing score is 70%, equal to 35/50 correct answers. Students have a maximum of 3 attempts, with a 24-hour wait between attempts. Retakes within the maximum attempt limit are included in enrollment at no additional cost.
Browser lockdown may be enforced. Tab switching, fullscreen exits, leaving the examination environment, opening new tabs, using secondary devices, having another person present, or engaging in suspicious conduct may result in warnings, manual review, termination, failed attempts, certificate denial, or permanent ban.
Cheating, impersonation, fraud, or confirmed severe examination misconduct may result in permanent ban, no refund, certificate revocation, and notification to relevant authorities if a certificate was issued.
9. Certification
Food Safety Academy issues a certificate to eligible students who complete required course modules, satisfy identity verification requirements, comply with examination rules, and achieve a passing score of 70% or higher on the final examination (35/50 questions).
Certificates are valid for 5 years from the issue date unless revoked earlier for fraud, error, misconduct, or legal or regulatory reasons.
Certificates are always available for download from the student dashboard at no additional cost. Students who need assistance accessing their certificate may contact support@foodsafetyacademy.ca at no charge.
Certificates are personal and non-transferable. A certificate may not be sold, assigned, shared, altered, forged, or used by any person other than the named certificate holder.
Food Safety Academy maintains the right to verify, suspend, correct, or revoke a certificate where there is evidence of fraud, impersonation, cheating, identity mismatch, payment reversal, administrative error, policy violation, or regulatory concern.
10. Intellectual Property
All course materials, text, videos, images, quizzes, examinations, question banks, certificates, platform content, trademarks, logos, design elements, documents, workflows, and related intellectual property are owned by Food Safety Academy or its licensors.
Users may access course materials only for personal learning and certification purposes. Users may not copy, reproduce, modify, distribute, publish, display, sell, license, scrape, translate, create derivative works from, or otherwise exploit Food Safety Academy materials without prior written permission.
All rights not expressly granted are reserved by Food Safety Academy.
11. Disclaimer of Warranties
The platform, course materials, examinations, certificates, and related services are provided on an "as is" and "as available" basis, subject to applicable law.
Food Safety Academy makes reasonable efforts to provide accurate, current, and reliable food safety education. However, FSA does not warrant that the platform will be uninterrupted, error-free, compatible with every device or browser, free from all security risks, or that course completion will guarantee employment, regulatory approval, business outcome, or any specific result beyond the certificate issued according to FSA policies.
Students remain responsible for complying with applicable food safety laws, employer requirements, health authority requirements, and workplace procedures.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Food Safety Academy, its directors, officers, employees, contractors, instructors, service providers, and affiliates will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of income, business interruption, loss of data, reputational harm, or loss of opportunity arising from use of the platform.
Where liability cannot be excluded, Food Safety Academy's total liability will be limited to the amount paid by the user for the course giving rise to the claim, unless a higher amount is required by applicable law.
Nothing in these Terms limits liability that cannot be limited under Canadian law.
13. Governing Law
These Terms are governed by the laws of the Province of Yukon and the applicable federal laws of Canada, without regard to conflict of law principles.
Any dispute arising from these Terms, the platform, the course, examination, or certificate services will be addressed in the Province of Yukon, Canada, unless applicable consumer protection law requires otherwise.
14. Changes to Terms
Food Safety Academy may update these Terms from time to time to reflect changes in law, regulatory requirements, platform functionality, course administration, examination procedures, payment practices, or business operations.
The updated Terms will include the effective date and version number. Material changes may be communicated through the platform, email, or another appropriate method. Continued use of the platform after updated Terms become effective means you accept the updated Terms.
